1. General Information

Pursuant to the provisions of Article 10 of Act 34/2002, dated July 11, governing information society services and e-commerce, BANCO BILBAO VIZCAYA ARGENTARIA, S.A. (BBVA) makes the following general information available to Users of the "BBVA Innovation Center Portal":

2. Access and Content

Use of this website (“Portal”) implies full acceptance of all the terms and conditions governing the same. By accessing the Portal the User accepts all such terms and conditions.

Use of the Portal's features, listed below, is restricted to users to which BBVA has granted access via corresponding passwords ("User(s)”). To access and use said features, Users must, via the initial Portal login page, enter the personal user data that is requested, which will have been previously provided by BBVA by email and/or sent to their cell phone. These login details will be verified by BBVA.

Users agree to make diligent use of their login passwords and are responsible for keeping them confidential, and agree to immediately report any unauthorized disclosure of the passwords to third parties, via email to [email protected]. Users are also liable for any damages that may be incurred due to the improper and/or negligent use of the passwords.

The Portal and all the functions included therein ("Service(s)") are the ownership of Banco Bilbao Vizcaya Argentaria, S.A. (hereinafter "BBVA" or "the Bank"). The services allow: 

a) registering of visits to the BBVA Innovation Center,

b) comments to be made on articles, videos, ratings, etc. that are posted, evaluations of the same and sending of the same to other users,

c) access to magazines, articles, documents, links to BBVA Group websites or those of third parties,

d) document downloads, e) registering for email alerts regarding recent posts on the Portal,

f) subscription to the Newsletter, which you will receive by email with no fixed regularity, to recommended documents and topical issues, and/or thematic bulletins,

g) access to news of interest on BBVA events or training activities, as well as other content, external blogs and BBVA photos and videos,

h) participation in chats, debates and blogs within the Portal configured by various Users.

i) participation in surveys conducted by BBVA concerning visits to the BBVA Innovation Center.

Authorization to use the Services is personal and non-transferable.

The Portal content is based on information and documentation that is available to the general public, as well as other information used internally by the Bank that may not be disclosed to third parties unrelated to the same. 

Any disclosure, reproduction or copying of the Portal’s content, whether total or partial, outside the area of the Portal, for whatever purpose and by any means, is strictly prohibited.

It is expressly forbidden to include in the Service any content that concerns religious beliefs or political ideas (including any declarations and symbols of all kinds of political parties and religious organizations), that are anti-social, offensive to cultural or religious values, provocative, pejorative, violent, obscene, of a sexual nature and/or from groups that are illegal or socially unacceptable, as well as any other that may impinge on the sensibility of third parties, jeopardize fundamental rights and public freedoms granted in applicable regulations and/or established in legislation regarding the rights of consumers and users, on the protection of children and minors, or that constitute or imply an invasion into the personal privacy or family lives of physical persons, or a violation of the right to reputation of third parties or confidentiality.

The inclusion by Users of content in the Service referring to: a) photographs, telephone numbers, URLs, addresses, e-mail addresses, names and surnames, as well as any other data relating to physical persons; b) appellations or trading names of enterprises, brands, logos, distinctive signs, anagrams, slogans, publicity, promotional material, declarations on authenticity, Olympic brands and the like; or c) images, music, videos, texts, objects, or any other products or media supports that are subject to limitations on dissemination or reproduction (copyright), or are protected by intellectual property rights, is subject to Users having the due rights for the content to be used both by themselves and other Portal users under the terms established in these terms and conditions, and to the aforementioned usage not infringing any legal provision, contract, rights or property pertaining to a third party, nor in any way constituting unfair competition.

Therefore, if any User includes any of the above contents, s/he shall be understood to have the necessary legal rights referred to above.

Users authorize BBVA to view all contents in all areas of the Portal and to record them in files held under its responsibility, including any personal data, for the purposes of managing the Portal and oversight.

Users may withdraw consent to use the content described above at any time by notifying BBVA, but given that said content is essential to the functioning of the Service, the aforementioned course of action will result in the automatic cancellation of the corresponding User’s membership of the Portal. 

The contents included in this Service, as well as those included in the websites accessible through the same, must be used in accordance with the terms of use that the owners of the sources indicated specify in their corresponding websites or original locations.

The information contained on the Portal is for educational and informative purposes, and does not represent a recommendation of any kind; nor may it in any case be considered as technical, legal, tax, financial or investment advice; nor an offer or guarantee by BBVA; nor should it be considered as a recommendation for carrying out transactions, or as a determining factor for decision making. BBVA does not accept any liability for the such use of the information contained in the Service that may be deduced this regard, and it must specifically be understood that such information, subject to the laws of Spain, is not intended for those Users who operate under jurisdictions of states requiring compliance with other requirements for the provision, disclosure or advertising of information.

The information provided by BBVA in the Portal does not represent a technical opinion by BBVA. BBVA does not necessarily agree with the information included in the Portal and cannot guarantee that the information contained therein will meet the User's expectations, nor that it is true, precise or complete. BBVA also accepts no liability for the opinions or comments that may appear in the information, based on the fact that they have either been made by the Users personally, or come from the indicated sources. BBVA accepts no liability for any losses, whether direct or indirect, that may result from use of the Services or their contents, nor does it accept any commitment to notify any changes made or to modify the content of the Services.

BBVA may restrict and/or deny access to functions of the Portal stated above should Users violate any of the provisions of these terms of use. Cancellation of Portal membership shall mean the cancelling member will no longer be able to access the Portal and all documents and/or information that said person has included in the same may be deleted.

BBVA accepts no liability for any events that could give rise to claims, or for any content or opinions that may be included in the Portal. Users are the only parties liable for their use of the Service and any uploaded content, with BBVA consequently exonerated from any liability whatsoever in connection with such use.

The User undertakes to make good use of the Portal, with good use understood to be in accordance with current legislation, the principles of good faith and public order.

The User agrees not to damage or disable the equipment or computer systems of BBVA or third parties. At the same time, the User agrees not to impede access to or the normal use of the Portal's contents.

Access to the BBVA Portal is free.

BBVA reserves the right to update, modify, or remove any information contained on the Portal, including content and/or services that are integrated within the same, and to restrict or deny access to such information at any time, without prior notice. In particular, BBVA reserves the right to eliminate, limit, or prevent access to its Portal in the event of technical difficulties caused by events or circumstances beyond its control that, according to the Bank’s judgment, impair or disable the standard security levels required for the adequate functioning of the Portal.

Under no circumstances whatsoever shall BBVA be liable for any loss, damage, or harm of any kind that may result from access to and use of the Portal, including, but not limited to, any caused to computer systems or that are the consequence of computer viruses and/or attacks. Furthermore, BBVA shall not be responsible for damage that Users may suffer as a result of improper use of this website, or for any crash, interruption, absence, or defect in telecommunications.

BBVA does not guarantee the truthful nature, integrity, or updating of information not produced by the Bank itself, and of information indicating another source, nor the information appearing on other websites accessed via hyperlink or link from the Portal, that are provided to the User, or uploaded by the Users registered on the Portal themselves, as alternative sources of information. Such information shall be governed by the terms and conditions of use dictated by the owners of such websites, and therefore BBVA assumes no liability with respect to any possible harm that may result from the use of the aforementioned information. The aforementioned hyperlinks shall under no circumstances be considered to represent any kind of recommendation, endorsement, or dissemination on BBVA’s part of the information, products, and/or services or, in general, contents that are owned by third parties, offered by the latter, or in any form disseminated by them.


3.Intellectual and industrial property

BBVA owns part of the contents of the Portal and has licenses to use the contents that are not its property.

Access to this Portal does not give Users any right or ownership whatsoever over the intellectual and/or industrial property rights of the contents it houses.

The Service is protected by laws governing intellectual property, including all copyrights, patents, trade secrets, trademarks and any other intellectual property rights, and it is strictly prohibited to distribute, reproduce, transmit, communicate, modify, transform, register or file all or part of it, whatever the means used, without the express prior authorization of BBVA, other than as expressly permitted by these Conditions of Use.

The intellectual property rights of this website, the screens displaying this page and the information and material displayed therein, as well as its lay out (by way of example but not limited to, source code, graphic design, software and content) belong to BBVA, unless otherwise noted and are protected by legislation on intellectual property, with the necessary licenses for use and cannot be exploited by the Users. Consequently, Users of the Portal agree not to reproduce, modify, display, sell, communicate, transform or distribute the Content, or otherwise use it for any purpose, without the permission of the author or BBVA.

It is not permitted to remove, avoid or manipulate the copyright notice ("copyright") or any other information identifying the rights of BBVA or third parties included in this Portal.

BBVA reserves the right to take any relevant legal action against Users who violate or infringe intellectual and/or industrial property rights.  


4. Personal data protection policy

At BBVA, we guarantee the protection of our clients’ data. The BBVA Portal does not automatically recognize any data referring to the identity of the visitors to its pages. All this information is handled in absolute confidentiality and is used for the purposes for which it has been requested.

The handling of the personal data mentioned above is governed by Spanish law, specifically Organic Law 15/1999, dated December 13, on personal data protection, together with its regulatory implementation.

Under the above law, the User may at any time exercise his/her right to access, cancel, rectify or object to his data, with no limitations other than those established by the said law, by notifying Banco Bilbao Vizcaya Argentaria, S.A., Customer Services Department, Apartado de Correos 1598, 28080 Madrid.

The information shall be handled and stored with due confidentiality, by applying measures of computer security established under the applicable law to prevent its alteration, loss, unauthorized handling or access, in accordance with the level of technology available and the nature of the data.




5. Use of cookies

This Portal gathers statistical information from the User by storing a cookie in his hard drive. The aforementioned information does not and cannot in any way personally identify the User, i.e. it is totally anonymous.

The information gathered will be used by BBVA to acquire better knowledge of the activity of visitors to the Portal with a view to improving the latter and increasing the effectiveness of its online presence.

The services of Google Analytics are used collect this information and submit it to statistical processing for BBVA; this implies that the gathering and storing of the information indicated (hereinafter, “the Processing”) is carried out using cookies directly between the User’s browser and the Google Analytics server.

When the User connects again to this Website, the aforementioned server will identify the code stored in the cookie, as indicated, and deliver the anonymous information referred to.

7. Applicable law

The terms and conditions established in these Conditions of Use are subject to Spanish law.
